WHEN MEETINGS TURN INTO BOXING MATCHES!

Most of us have seen association meetings getting very emotional. That’s no miracle since the topics of home and money stir up minimum as many emotions in human beings as religion and politics.
Shouting matches are actually pretty common in such meetings. I have watched many videos of meetings of board and/or membership meetings turning pretty wild. I guess some folks wish they would have never said what was shown on tape if they watch it a day later. Too many people are making an a.. out of themselves at such meetings. Never forget: Civilized meetings definitely create better results!
But not all heated discussions just end in verbal exchanges with lots of screaming and yelling.
Some of these emotional discussions actually don’t stop with threats, some really turn physical. Over the years there have been many reports in the media about actual fights at such meetings and people even going to jail over it.
I still remember the story from Ocala where two homeowners attacked a representative of developer Zacco at a meeting of concerned owners (see: Meeting turns violent; two arrested). For these two the meeting ended in jail. It seems the name Zacco stirs up lots of emotions in Ocala ’s communities as we could see at a recent HOA meeting organized by the Division and Senator Hays. I think most owners in that area feel that the police should rather arrest some Zacco family members instead of homeowners.
It doesn’t happen too often that such meetings turn violent, but most often it is foreseeable that it might happen. There are a lot of warning signs popping up before such confrontational meetings! And the people in charge should take notice – before somebody ends up in the hospital or the jail.
Sometimes an off-duty police officer in uniform will stop the feuding parties from getting physical.
But police officers can as well create a lot of havoc at owners’ meetings. Remember the case of the Fontainebleau Terrace Owners’ Association in Panama City Beach , where police officer Donald Nichols, in an attempt to help his “buddy” Cam Ray McDonald, actually started the violence and arrested a condo owner, injuring others? (THIS IS A CONDO BUST -- NOT A DRUG BUST!). The police department was sued and police officer Nichols resigned. But guess what: He became a licensed CAM (License Number CAM36678*). I guess he chose that profession in order to be able to continue his bullying tactics?
But in most instances hiring a police officer will guarantee a more peaceful meeting – meaning the expense of paying an officer to be present at the meeting pays dividend. Shouldn’t we all be able to look forward to a nice community meeting without screaming, yelling or even a brawl?

Imagine the scenario: Owners try to hold a peaceful assembly -- as guaranteed by the Florida Statutes -- to decide whether or not they want to recall their association board. (Owners claim that the board members are puppets of Ray McDonald, the employed manager of the community.) One of the main reasons to recall: Alleged financial mischief -- money seems to be missing and the owners have been refused access to the financial records for many months. Complaints to the DBPR didn't do any good!
The meeting was noticed -- as required by law -- and the signs outside the room clearly indicated: "Owners Only!" The owners even hired a security guard to make sure that only owners had access. All was working according to Florida Statutes -- until Panama Beach Police Officer Donald Nichols showed up. Then the chaos started that left two owners injured and one owner in jail!
CAM McDonald had different ideas about an "Owners Only" meeting (quote): "I am the community manager, I can come anywhere I want!" With the help of Panama City Beach Police Officer Donald Nichols (quote): " I'm not allowed in here, AM I? You're gonna stop ME?" McDonald bullies his way into the meeting room, injuring two owners and having Nichols arrest an owner who happened to stand in his way. Officer Nichols continued to bully the mostly elderly owners by threatening an elderly lady: "You stand in my way, you're going to jail too!"
And to add insult to injury: PCBPD Lt. Jeffrey Heath refused to take statements of the injured owners trying to file a complaint at the station later this afternoon saying: The only report that would be written would be by officer Nichols!
If this is what the Panama City Beach Police Department understands as "To Protect And Serve" it is absolutely no surprise why Panama City Beach has the nickname "Red Neck Riviera!"
This CONDO BUST and the reaction of Lt. Jeffrey Heath is a sure indication what this Department is all about!

Since we are just in the middle of a serious debate about property taxes, we might consider that it's not even a serious threat if county and city commissioners threaten that they have to let go of police officers if they have to further reduce the taxes. Considering the service we citizens receive from police officers like Donald Nichols, it might even be a great idea? Because without his interference -- what did he do in a private building in the first place since there was no report of criminal activity -- law-abiding citizens wouldn't have been hurt! Don't forget, without the back-up of Officer Nichols CAM McDonald, who is coincidentally a former police officer himself, would have never dared to bully his way into an Owners Only meeting! A thorough investigation is definitely necessary, because there is obviously more to the "Condo Bust" then what we saw on the video!

(Please read the response I received by email regarding the Wednesday, October 15 confrontation with Mr. Nichols.)
On Wednesday, October 15, I had a discussion with the Property Manager regarding his refusal to send me information regarding the mail out of the End of Year Correspondence. Initially, prior to the mailing of the documentation to owners, I requested that management send a “draft” of what was planned to be mailed and I was refused this information. After several more requests to send me the information by email, the only response from management was that it had been mailed according to Florida Statutes. At the Wednesday meeting, Mr. Nichols again refused to give me a copy; an email would have suffused, therefore his reference in his response email (see attached) that his printer was out of ink is just another one of his excuses and has nothing to do with my original request.
During this short meeting and this Board member’s request again for copies, I was first told it was in the mail and I should get it that day. The reason I first requested copies was to proof read for any errors or omissions. This is a new management firm and I simply wanted to be sure the information being disseminated to Owners was accurate. Upon receiving it in the mail, there are several errors that I found. If it had been given to me as a draft, the end result would not have had these errors. As Mr. Nichols has become famous for saying, “We are all human and make mistakes”. His refusal to furnish me with the information is because I am not his boss. He told me Ms. Webber, as the Chief Executive Officer is his boss. He has told me that Ms. Webber is his boss on several occasions when I have requested information from him. Just so all of you know, Ms. Webber has instructed me not to contact her, but to go to the Property Manager with my requests. Does that mean that The President of our Association has instructed the new Management Firm not to give me any information?
During this meeting, I again reminded Mr. Nichols that The Association is his employer, not Ms. Webber. Ms. Webber is his primary contact according to our By Laws, but not his boss – The Association is his boss and he should treat all Board Members requests as a request of his employer – especially since this Board Member has been instructed not to speak to Ms. Webber. Upon reminding Mr. Nichols that Ms. Webber is not his boss and that he answers to the Board, he jumped up out of his chair, threw his pen down and shouted at me that Ms. Webber is his Boss according to the By-Laws and t State Statutes. He frightened me by his aggressive moves and I turned and left his office. I did not storm out of his office as he claims. Ms. Blue was in the office at the time and can testify to the disruption that was above normal levels of a professional discussion between a Board Member and a Property Manager.
Therefore, I am requesting that the security cameras in the COA office that have been disabled by the Property Manager be reconnected for safety reasons, immediately. This system was an important tool when we had a disgruntled employee in the past and was the final “witness” that the employee be relieved of his employment because of what was witnessed on the video of his encounter with then Manager, Ms. Turnipseed.
Thank you for considering my request. I would like to have this issue added to the Agenda for the October 25th meeting, also.
